GENERAL TERMS AND CONDITIONS

  1. General

(1) These General Terms and Conditions of Sale (hereinafter "GT&Cs") shall apply to all contracts concluded between a customer (hereinafter "you") and us, UrBestSelf GmbH, Marienburger Str. 1, 10405 Berlin (hereinafter "UrBestSelf", "us" or "we") via our online shop at www.urbestself.de (hereinafter "Online Shop"), for which German law is applicable. Conflicting or deviating terms and conditions of the customer shall not apply; all terms and conditions of the customer are hereby objected to.

(2) Our product offers in the Online Shop are only aimed at consumers within Germany. For the purposes of these GT&Cs, a consumer is any natural person who enters into a contract for a purpose that can be attributed primarily neither to their commercial or their independent professional activity (§ 13 BGB), but rather to their private life.

  1. Minimum requirements for conclusion of a contract

The product range in our Online Shop is exclusively aimed at buyers aged 18 years or above. If you are under the age of 18, you may only use it with the assistance of a parent or guardian.

  1. Conclusion of a contract

(1) The offers in our Online Shop are subject to change and serve solely for your information about our products prior to you submitting your purchase offer to us. Via the buttons, you can select our products in the Online Shop before placing them "into your shopping cart" without obligation.

(2) It may be the case that individual products posted in our Online Shop are not available at certain times. Together with other information about the product, we will also inform you about its availability in the Online Shop. If the product selected by you is not currently available, you will not be able to add it to your shopping cart.

(3) All products shown in our Online Shop are only sold in quantities that are common for households.

(4) You can view your shopping cart at any time by clicking on the button displaying a shopping cart and, if necessary, specify the quantity of products in the input area. To buy the products in the shopping basket, it is necessary to click on the button "Checkout". By clicking on the "Buy" button in our Online Shop you submit an offer to conclude a purchase contract for the goods in your shopping cart. In order to submit your offer and to click on "Buy", you first have to click on the fields "I have read the General Terms and Conditions of Sale and hereby consent to them." and "I have read and accepted the cancellation instructions."

(5) We will automatically send you an order confirmation by e-mail, in which we will inform you about the receipt of your order. The contract of sale shall only be concluded with the dispatch of an order confirmation or with the provision of the goods by us for dispatch. Together with the order confirmation, we will also send you these GT&Cs and, if necessary, the mandatory information for consumers in the case of distance sales transactions.  

  1. Prices and shipping costs

(1) The prices stated in our Online Shop include the statutory value added tax, but are exclusive of the shipping costs. The shipping costs are shown in the detailed view for the respective product.

(2) We only ship our products to recipients residing within Germany.

(3) The shipping costs charged by us depend on the number and size of the products you ordered. If you order multiple products, the shipping costs will be based on the largest shipping class.

(4) The final price including the statutory VAT and the applicable shipping costs will be communicated to you in the checkout area of our Online Shop before you decide to order by making a payment.

(5) As a matter of principle, we keep all the goods offered in our Online Shop in stock. In rare exceptional cases, we will indicate an imminent delivery date or any delivery restrictions in the event of limited stocks of goods. We are entitled to make partial deliveries insofar as this is reasonable for you.

(6) Goods are dispatched to addresses in Germany within five working days (Monday to Saturday), unless otherwise stated for individual offers. The delivery period commences on the day after receipt of payment by us. The observance of tax, customs and export regulations lies in any case with you or the carrier you have commissioned.

  1. Shipping

For all deliveries we are entitled to determine the type of dispatch (in particular transport companies, dispatch route, packaging) ourselves. 

  1. Terms of payment

(1) Payment is to be made either by Paypal or by credit card.

(2) You are only entitled to set off if the counterclaims are legally established or undisputed; this shall not apply to offsetting with claims from statutory liability for defects. You may only exercise a right of retention if the counterclaim is based on the same contract.

  1. Retention of title

The goods shall remain our property until full payment is made. 

  1. Liability for defects and warranty

(1) The liability for defects (warranty) is based on the statutory provisions. The limitation period is two years and commences with the handover of the goods.

(2) A warranty in addition to the statutory liability for defects shall only exist for our goods if this is expressly provided in the description of the goods or the order confirmation. No warranty shall affect your claims arising from the statutory liability for defects.

  1. Right of withdrawal in accordance with §13 BGB (German Civil Code)

If you are a consumer (§ 13 BGB), you have a right to cancel orders in our Online Shop, which we inform you about as follows:

(1) Cancellation policy

Right of withdrawal

You have the right to cancel this contract within 14 days without giving any reasons.

The withdrawal period shall be 14 days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the products.

In order to exercise your right of withdrawal, you must contact us (UrBestSelf GmbH, Aslaner Straße 3, 33100 Paderborn, Tel: +49 0176 3456 2103, E-mail: hello@urbestself.co) by means of a clear declaration (e.g. a letter or e-mail sent by post) about your decision to cancel this contract. You can use the attached sample withdrawal form, which is not mandatory.

To maintain the withdrawal period, it shall be sufficient for you to send the notice about the exercise of the right of withdrawal before the expiry of the withdrawal period.

(2) Consequences of cancellation

Should you cancel this contract, we shall refund all payments we have received from you, including the delivery costs (with the exception of the additional costs resulting from the fact that you had chosen a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within 14 days of the day upon which we received the notification of your cancellation of this contract. We shall use the same method of payment you used in the original transaction, unless otherwise agreed with you; in no case will you be charged for such repayment. We may refuse to refund until we have received the products back or until you have provided proof that you have returned the products, whichever is the earlier.

You shall return or deliver the products to us (UrBestSelf GmbH, Aslaner Straße 3, 33100 Paderborn) immediately and in any case within 14 days of the day upon which you inform us about the cancellation of this contract. The deadline shall be deemed to have been met if you send the products before the expiry of the period of 14 days.

You shall bear the immediate costs of returning the products.

You shall pay for any loss of value of the products only if this loss of value is due to a handling of them that is not necessary to check the condition, characteristics and functioning of the products.

  1. Applicable law

The entire existing legal relationship and any contract concluded between us and you shall be governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on contracts for the International Sale of goods (CISG). 

  1. Final provisions

Should individual provisions of these GT&Cs be or become invalid, in whole or in part, the validity of the remaining provisions shall not be affected thereby. In this case, the law shall apply instead of the invalid provision.
